Anthony Kovalcik
Anthony “Tony” Kovalcik is a highly experienced board-certified construction attorney who represents a wide variety of construction professionals, assisting them on a broad range of private and public projects. Tony’s practice covers the full lifecycle of construction matters – from contract negotiation, drafting and review through dispute resolution in multiple forums, including arbitration, litigation (in state and federal trial and appellate courts), and administrative hearings.
Tony’s recent work includes the representation of a general contractor joint venture partner on a $245 million transportation operations center in Miami; an EPC contractor on a $500 million power generating facility in Maryland pursuing more than $225 million in claims against the project owner in federal court; a design-builder on a more than $1.3 billion light-rail transit project in Los Angeles in pursuing more than $675 million in claims for delay and disruption; a general contractor in litigating disputes with its shell subcontractor in excess of $10 million in state court arising from the construction of a 1.4 million square foot mixed-use high-rise development including affordable senior housing in Miami, Florida; and a general contractor in performing contract reviews for public infrastructure and commercial projects totaling more than $300 million.

Biography
In his almost three decades with Moye O’Brien, Anthony “Tony” Kovalcik has had the honor of representing and serving general contractors, construction managers, engineering firms, and other construction professionals on a wide variety of public and private projects, ranging from the C.W. Bill Young 15.5 billion gallon Regional Reservoir in Hillsborough County, Florida; the Golden Gate Bridge in San Francisco; the Wildcat Point 1,000-megawatt gas-fired combined cycle Power Generating Facility in Maryland; the McCook Reservoir Distribution Tunnel System Project in Chicago; the Savannah River Site Nuclear Facility in South Carolina; and the state-of-art NCL Cruise Terminal and Adrienne Arsht Performing Arts Center in Miami.
Tony is Board Certified in Construction Law by The Florida Bar and AV rated by Martindale-Hubbell. His practice involves a broad range of issues, including contract preparation, review and negotiation, project support, contract disputes, payment and performance bond issues, construction defects, construction liens, bid protests, DBE and SBE certification, and design professional liability, on both private and public construction projects. Tony has actively litigated cases in the state and federal courts of Florida as well as a number of other states, including at the appellate level, and in a variety of arbitrations, mediations and administrative proceedings.
Tony’s recent work includes the representation of a general contractor joint venture partner on a $245 million transportation operations center in Miami; an EPC contractor on a $500 million power generating facility in Maryland in pursuing more than $225 million in claims against the owner in federal court action in Virginia; a general contractor as project and litigation counsel on a $160 million mixed-used high-rise in Miami in pursuing $10.1 million in claims and defending against $9.5 million in claims in state court in Miami, Florida; a construction manager as project counsel on a $200 million state-of-art cruise terminal project in Miami; a design-builder on a more than $1.3 billion light-rail transit project in Los Angeles in pursuing more than $675 million in claims; and a contractor in the successful defense of a bid protest on an airport terminal project in Key West.
