Moye O’Brien represented the design-builder in identifying, developing, prosecuting, and successfully resolving claims seeking additional compensation and time extensions from the project’s owner. It also represented the design-builder in developing, pursuing, and arbitrating claims seeking hundreds of millions of dollars in claims for preferential changes, design errors and omissions, delay, and disruption costs. The disputes arose from a major infrastructure upgrade in Denver, Colorado, reconstructing a 10-mile stretch of Interstate 70. It added a tolled express lane in each direction, removed a 54-year-old viaduct, lowered the interstate between Brighton and Colorado Boulevards, and constructed a four-acre park over a section of the lowered roadway. The project received multiple awards, including ARTBA’s Community Impact of the Year Award.
