Megan Cantlebary

Megan Cantlebary is a partner with Moye, O’Brien & Masterson, LLP. She is a board-certified construction lawyer with extensive experience representing general contractors, design-builders, and other construction-related entities throughout all phases of construction projects and dispute resolution. Megan’s practice focuses on working with her clients to navigate claim development to recover high-dollar assets on complex public works projects, with a strong focus on minimizing risk and achieving successful project completion. With two decades of experience, Megan has successfully resolved construction claims and disputes involving such issues as delays, disruption, scope changes, and defective work in federal and state courts and in alternative dispute resolution forums throughout the United States and consulted on projects internationally.   

Megan’s recent work includes the representation of a design-builder with respect to various project issues on a $2.5 billion light-rail public-private partnership project, and a design-builder on an over $1.3 billion light-rail transit project in Los Angeles with more than $675 million in claims against the Owner and various subcontractor claims. Megan is currently representing a design-builder in an arbitration seeking more than $120 million in claims from a subcontractor. She has also recently been engaged in representing a design-builder in developing and pursuing various disputes on a $2.5 billion light-rail public-private partnership project in Ontario, Canada.

Biography

Megan Cantlebary is a partner with Moye, O’Brien & Masterson, LLP. She focuses her practice on representing prime contractors throughout the United States relating to multi-million and billion dollar public works projects. Megan has been involved with all aspects of the construction industry, from procurement (contract preparation and negotiation through bid protests) to claim development and prosecution/defense of claims, in all forms of dispute resolution (mediation, arbitration, dispute review boards and litigation before state and federal courts). She has experience in a vast array of cases in several states, ranging from pure construction matters in the commercial sector (airports, bridges, highways, water treatment plants, dams and appurtenant facilities) to false claims litigation (state and federal law) as well as proceedings involving the uniform foreign money judgment recognition statutes. Megan’s practice also includes assisting clients with risk evaluation and contract analysis for public and private project procurements.

She has been an integral team member on many high-profile, high stakes construction disputes on heavy civil projects throughout the United States and Canada including consulting work for a design-build contractor client with claims in excess of $100 million on a $600 million light rail project in Waterloo, Canada; support for the claim development for the design-builder on a $1.1 billion highway project involving in excess of $100 million in claims in El Paso, Texas; and representation of a design-builder on an over $1.2 billion heavy civil project in Denver, Colorado.

Her recent work includes the representation of a design-build contractor consortium led by an ENR top 10 general contractor and an ENR top 15 general contractor in connection with DRB proceedings. She has also assisted in the development of substantial claims on an over $1.3 billion light-rail and station project in Washington DC, and the representation of a design-builder in the development and pursuit of a delay and disruption claim on a $1.3 billion light-rail design-build project in Los Angeles. Last, she is helping represent a design-builder with respect to various project issues on a $2.5 billion light-rail public-private partnership project in Ontario, Canada. She is also representing a design-builder in pursuing $130 million in claims against a subcontractor in arbitration.
